DMCA
Last Updated: September 7, 2024
Welcome to https://prettyedition.xyz (the “Site”). We respect the intellectual property rights of others and expect our users to do the same. In compliance with the Digital Millennium Copyright Act (DMCA), Title 17, U.S. Code, Section 512(c), copyright owners or their agents can submit a takedown notice to our designated DMCA Agent as outlined below.
As an internet service provider, we may claim immunity from copyright infringement claims under the DMCA's “safe harbor” provisions. To submit a takedown request, please provide a good faith notice that includes the following details:
Notice of Infringement – Claim
To file a DMCA takedown request, the copyright owner or their authorized agent must provide the following information:
- Signature: A physical or electronic signature of the copyright owner or an authorized representative.
- Identification of the Copyrighted Work: A description of the copyrighted work claimed to be infringed.
- Identification of Infringing Material: A description of the infringing material to be removed, including sufficient information to locate it (e.g., the specific URL).
- Contact Information: Your name, physical address, email address, phone number, and fax number (if applicable).
- Good Faith Statement: A statement affirming that the use of the material in question is not authorized by the copyright owner, their agent, or the law.
- Accuracy Statement: A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Please note that Title 17 U.S.C. §512(f) imposes penalties, including court costs and attorney fees, for knowingly submitting false claims of infringement.
How to Submit a Notice:
Submit your DMCA takedown notice via our Contact page or by email for faster processing at [email protected].
Important Notice:
When submitting a DMCA claim, you acknowledge and agree that we may share your identity and claim details with the alleged infringer. By submitting the claim, you consent to this disclosure.
Counter Notification – Restoration of Material
If you believe that your content was mistakenly removed due to a DMCA takedown, you may file a counter notification with our DMCA Agent. The counter notification must include the following details as required by 17 U.S.C. §512(g)(3):
- Signature: Your physical or electronic signature.
- Description of Removed Material: A description of the content that was removed and its location before removal (e.g., the specific URL).
- Good Faith Statement: A statement, under penalty of perjury, that you believe the content was removed due to a mistake or misidentification.
- Contact Information: Your name, address, phone number, and a statement consenting to the jurisdiction of the federal district court for your address (or if you are outside the U.S., consenting to the jurisdiction of any district where the service provider is located). You must also agree to accept service of process from the person or entity that submitted the original infringement claim.
How to Submit a Counter Notice:
Send your counter notice through our Contact page or via email at [email protected].
Repeat Infringer Policy
We take copyright violations seriously. As required by the DMCA, we maintain a list of DMCA notices and track users who may repeatedly infringe copyright. Users identified as repeat infringers under our policy will have their accounts terminated.
